Spam Prevention and Eradication
Special Note To Spammers:
Be it noted that this domain and it's related domains do
NOT willingly accept spam.
We have negotiated with an
international Collection Agency (offices worldwide), whose contract
with us involves a very healthy commission rate to them to pursue
anyone (individual or corporation) who spams, or authorizes spam, to
the BestPrac.Org or any related domain.
Any unsolicited email which "a reasonable person" would
recognize as fitting the generally-accepted definitions of spam will
attract a fee payable to us of $US500 per such unsolicited email
received. The persons/corporations liable will be any and all of the
following:
- The person/s and/or corporation/s
directly responsible for sending the unsolicited email;
- The person/s and/or corporation/s who authorized
and/or delegated the task of sending the unsolicited email;
- The person/s and/or corporation/s who stand to
benefit or are attempting to gain benefit from the spamming
The sending of any such an unsolicited
email to the BestPrac.Org or any related domain constitutes acceptance
of this notice and agreement that such sending constitutes the
formation of a legally binding contractual arrangement.
This notification applies to all such
unsolicited emails received after 9:00pm AEDST, February 10th, 2001.
Furthermore:
- In addition to the above contract,
we reserve all rights and remedies granted under the Statutes and
Common Law of any and all applicable jurisdictions;
- We shall utilize all legal technological means
available to us to trace the immediate and upstream service providers
(as widely defined) of spammers, and submit abuse reports documenting
the offences committed, requesting the termination of all accounts and
services associated with the spammer; and
- As applicable, we shall lodge nominations for
blacklisting of offending spammers (and uncooperative service
providers) with the various filtering services available to the
internet community.
